The use of the Eletronode platform and the services available or provided through this site is subject to these terms and conditions (“Agreement”), which is a legally binding document for the user (“User”).

1. Eletronode Services

1.1. Eletronode.com (“Site”) is a platform developed and managed by Eletronode (“Eletronode”), which allows Users to participate in discussions in: forums, blogs, user groups, and access: videos, images, free eBooks, and paid courses on various platforms, including YouTube, Instagram, Facebook, Pinterest, TikTok, and X (formerly Twitter) (“Platform”). The use of the Platform and the Services is governed by this Agreement, including other documents and policies available on the Platform (such as the Eletronode Privacy Policy and General Terms and Conditions of Sale).

1.2. By accepting this Agreement, the User can use the services accessible through the Platform, specified in section 1.1 (“Services”).

1.3. Using the Site does not require the mandatory activation of an account; however, using the Services requires the activation of a personal and unique User account (“Account”).

1.4. To use some features of the Platform, it is necessary to create an Account and purchase a service available for payment (“Premium Services”). Premium Services are products that the User can buy from the Eletronode online store.

2. User Account

2.1. If the User creates an Account, a unique username and password will be associated (“Account Credentials”).

2.2. The User must take all necessary measures to ensure that the Account Credentials are kept strictly confidential and accepts responsibility for any loss or damage to Eletronode and/or third parties resulting from non-compliance with this confidentiality obligation. The User agrees not to disclose the Account Credentials and the information accessible through them and not to allow access to the Platform, Services, and Premium Services to others through the use of their Account Credentials or otherwise through their Account. If the User becomes aware of unauthorized access to their Account, they must change the password and notify us immediately at privacy@eletronode.com.

2.3. The User must provide real and accurate information when creating the Account (and whenever updating their data) and, to ensure the Account’s security, agrees to:

• not provide false information;
• not create fake or duplicate Accounts;
• update their personal information whenever requested to comply with the provisions of this Agreement;
• not share or transfer the Account Credentials;
• not adopt as Username or ID names that violate the law or third-party rights (in which case, Eletronode will have the right to suspend the registration or Account until the critical aspect related to the name is resolved).

2.4. If the User does not verify the Account by clicking the confirmation link sent by email during the registration process, the relevant Account will be deleted one month after the registration request.

3. User Duties

3.1. The User acknowledges that using the Services and Premium Services in accordance with the Agreement is essential for the proper functioning of the Platform and for the use of the Services by other Users. Therefore, when creating, modifying, and publishing content, including but not limited to software or libraries (“Content”), the User must comply with the provisions of this Agreement, the procedures, and open-source license schemes adopted by the Eletronode community, and applicable legal provisions, observing the principles of good faith, truthfulness, and fairness in relationships with other Users.

3.2. The User will use the Platform in accordance with this Agreement and for the purpose of using the Services and Premium Services. Specifically, the User agrees not to:

• transfer or resell the Services, Premium Services, or their right to use the Platform to third parties;
• tamper with or operate on the Platform’s hardware without Eletronode’s intervention and authorization;
• use the Site, Services, or Premium Services if the Account has been temporarily or permanently suspended;
• use the Platform to create or incorporate other datasets correlated to Eletronode to be used in a service similar or identical to the Service or Premium Services;
• provide Eletronode with false, inaccurate, misleading data or that causes adverse consequences to third parties;
• transfer the Account or communicate the Account Credentials to third parties without Eletronode’s prior written consent;
• spread viruses, malware, or any other technology designed to harm the Platform, the Site, other Users’ devices, violate Eletronode’s or other Users’ rights, compromise the proper implementation of the open-source license schemes used by the Eletronode community, or in any way hinder or disrupt other Users’ use of the Services or Premium Services;
• copy, modify, or disseminate the Platform’s content, Services, Premium Services, or proprietary information belonging to Eletronode and/or others (without prejudice to the provisions of the open-source licenses applicable to the software, if accessible through the Platform);
• use any mechanism, software, or procedure that may interfere with the proper functioning of the Platform;
• circumvent instruments prepared by Eletronode to ensure the Platform’s security and prevent intrusions or access by unsolicited automated users (such as robots, spam, spiders);
• upload to the Platform or otherwise communicate or send through the Platform to other Users content (text or graphic or any other type) that is offensive, vulgar, violent, false, harmful to Eletronode’s image, or contrary to law, or in violation of third-party rights or the open-source licenses used by the Eletronode community;
• copy, download, duplicate, distribute, disseminate, or in any way use – even partially – images, distinctive signs, texts, and content belonging to Eletronode or otherwise found on the Platform;
• export any information outside the Platform, except in cases expressly governed by this Agreement and without prejudice to the rights granted by the open-source licenses used by the Eletronode community.

3.3. If Eletronode believes, in its sole discretion, that the User has engaged in behavior(s) that may cause technical problems or legal liabilities or that are in violation of the provisions of the Agreement, Eletronode may, without prejudice to other remedies, limit, suspend, or terminate the availability of the Services, Premium Services, and/or Account, and take technical and legal measures – including removing illegal content – to prevent the User from using the Services and Premium Services unlawfully or in breach of the licensing agreements the User is required to comply with.

3.4. To maintain the Platform’s functionality at optimal and secure levels, the User may report technical problems using the following Contact Form [contact form link].

3.5. The User agrees to indemnify and hold harmless Eletronode, as well as its directors, employees, managers, agents, and any subsidiaries and/or parent companies of Eletronode, from any damage resulting from the User’s violation of the terms and conditions of this Agreement.

4. Use of Services and Premium Services

4.1. Eletronode will keep the Platform active and accessible through the Site, providing technical assistance to resolve problems related to Account use due to issues on the Platform attributable to Eletronode, through the Contact Form [contact form link]. Given the nature of the Services and Premium Services, the User acknowledges that Eletronode will not be responsible for access issues to the Platform due to causes not directly connected to Eletronode’s activities or for which it is responsible, and specifically:

• problems related to connectivity and continuity of Internet traffic available to the User;
• problems related to the User’s IT systems;
• problems related to the terminals used by the User, including malfunctions of devices used by the User and including cases where those devices (such as smartphones, tablets, computers) are not compatible or fast enough to allow the use of the Services;
• interruption of the User’s Internet network access;
• incompatibility between the User’s mobile device or browser and the Platform;
• any other event that may compromise the User’s access to the Platform and is not directly attributable to Eletronode.

4.2. The User may access the Platform through mobile devices and use the mobile version of the Platform. Eletronode provides the mobile version of the Platform free of charge to the User, subject to any payment due to the User’s Service Provider for Internet access. Consequently, the User acknowledges that Eletronode will have no liability for such payment, which will be regulated between the User and the Service Provider.
